WASHINGTON, D.C. (October 15, 2012) – The American Chemistry Council (ACC) issued the following statement after the submission of formal comments on Thursday to the California Department of Toxic Substances Control (DTSC) regarding the latest proposed Safer Consumer Products Regulations:
“Despite our considerable efforts over the last five years to suggest meaningful, practical and legally defensible regulatory alternatives to DTSC, the current proposal demonstrates limited progress in critical areas of the regulation. Although minor changes are reflected, the proposed regulations fall short of having a strong objective and scientific foundation in order to credibly inform choices made by consumers and other participants in the value chain. In ACC’s view, the regulations require considerable additional work before they are made final.
“Our comments strongly recommend that DTSC’s approach provide regulatory certainty in how chemicals and products are selected and evaluated, and ensure that the totality of relevant and reliable information is considered when assessing potential hazards of identified chemicals.
“We also share the concerns of Senator Michael Rubio and other legislators regarding the poor economic analysis provided by DTSC. The Department’s report fails to give any indication of potential costs to businesses throughout California, the total number of businesses created, and the number of businesses that will be eliminated. With a regulation of this size and scope, it is imperative that we have a more complete understanding of the economic impact to the state of California before the rules are finalized.
“We remain committed to an ongoing and constructive dialogue with DTSC, the Governor’s office, and state legislators to ensure a rational, predictable, science-based regulatory environment that enhances public health, protects innovation and promotes consumer confidence in products.”
