WASHINGTON (August 3, 2015) - The American Chemistry Council (ACC) issued the following statement in response to the release of the U.S. Environmental Protection Agency's (EPA) final greenhouse gas (GHG) regulations for electric generating units (EGUs), also known as the Clean Power Plan (CPP):

"We are relieved that EPA has recognized that industrial combined heat and power (CHP) units should not be subject to the final CPP. Given the environmental benefits of CHP and the U.S. government's efforts to promote growth of industrial distributed generation, doing so makes good policy sense. Expanded deployment and use of industrial CHP can help make electricity generation more efficient and reliable while lowering emissions.

ACC co-sponsored a report, ' Combined Heat and Power as a Compliance Option under the Clean Power Plan ,' that provides guidance on how states can include CHP in their implementation plans. It also describes how to measure and verify GHG emissions reductions from CHP projects.

"However, we remain concerned about the new credit trading system and the potential impact of the rule on our nation's economy, the effect it could have on the U.S. manufacturing sector and the rule's potential to undermine the ability of the chemical sector to continue to grow and create jobs by raising costs for businesses and consumers."

"We are planning a more in-depth review of the rule's language and details, but given the breadth of this Plan, we continue to question whether EPA has the legal authority under the Clean Air Act to fundamentally change and regulate our nation's electricity system."

WASHINGTON (June 12, 2015) - Following on the heels of a Senate vote to approve the Bipartisan Congressional Trade Priorities and Accountability Act of 2015 (TPA-2015), the U.S. House today voted to pass legislation that would grant President Obama Trade Promotion Authority (TPA). The American Chemistry Council (ACC) issued the following statement:

"ACC applauds House and Senate leaders for joining the vast majority of Americans that say they would vote 'yes' to trade promotion authority. We now urge the House to resolve the remaining procedural hurdles to ensure that the bill can be sent to the President for signature.

"For months, ACC and our  members have worked with leaders in the House and Senate to illustrate how TPA could help unleash massive growth potential for U.S. chemical exports. We are already one of the nation's leading export industries, surpassing $190 billion in chemical exports in 2014. We estimate that number could grow to $282 billion by 2019 due to the competitive impact of increased supplies of natural gas, even before any new trade deals are completed.

"With TPA in place, U.S. trade negotiators will be in a stronger position to see historic free trade agreements, like the Transatlantic Trade and Investment Partnership (TTIP) and Trans-Pacific Partnership (TPP), cross the finish line. TPA is an important administrative and substantive tool to broaden global market access of U.S. goods and services and resolve long-overdue trade issues limiting manufacturing growth in the United States and around the world.

"ACC looks forward to continuing to work with Congress, the Administration and our coalition partners to secure the completion of groundbreaking trade deals like TPP and TTIP that will demonstrate U.S. leadership and provide a significant boost to the American economy."

Our nation’s primary chemicals management law must keep pace with scientific advancements and ensure that chemical products are safe for intended use—while also encouraging innovation and protecting American jobs.

Policy Background

Congress passed bipartisan comprehensive reform legislation to update the regulation of chemicals for the first time in 40 years, modernizing the Toxic Substances Control Act (TSCA) to meet the needs of the 21st Century. The Frank R. Lautenberg Chemical Safety for the 21st Century Act (LCSA) was signed and enacted into law on June 22, 2016.

More effective federal oversight of chemicals will give Americans greater confidence that chemicals in commerce are being used safely and reduce the number of inconsistent state-based chemical initiatives that impede interstate commerce and send mixed messages to consumers.

The anniversary is worth commemorating because LCSA is vital to protecting human health and the environment.




Thanks to the LSCA, America’s manufacturers will have the regulatory certainty they need to innovate, grow, create jobs and win in the global marketplace—at the same time that public health and the environment benefit from strong risk-based protections.

LCSA Improves and Strengthens TSCA By:

  • Subjecting all new and existing chemicals to an EPA safety review
  • Requiring EPA to focus on chemicals that are the highest priorities for full risk-based safety assessments
  • Strengthening transparency and the quality of science used to make EPA decisions
  • Expanding EPA’s ability to require additional health and safety testing of chemicals
  • Allowing industry to request that EPA conduct a safety assessment on a specific chemical
  • Providing EPA with a full range of options to address the risks of substances including labeling requirements, use restrictions, phase-outs or other appropriate actions
  • Setting aggressive and attainable timelines for EPA to complete its work
  • Promoting cooperation between state and federal regulators while creating a strong national chemical regulatory system, ensuring interstate commerce is not disadvantaged
  • Strengthening protections for the most vulnerable like infants, children and the elderly
  • Protecting Confidential Business Information (CBI)

    At the 21st Annual Responsible Care Conference and Epo this morning, the American Chemistry Council (ACC) honored 19 of its member companies for implementing energy-efficiency improvements in 2011.     At the 21st Annual Responsible Care Conference and Epo this morning, the American Chemistry Council (ACC) honored 19 of its member companies for implementing energy-efficiency improvements in 2011. ACC presented a total of 67 awards to these companies, 16 of which were deemed programs of Eceptional Merit.
